Re: OFFER OF EMPLOYMENT FOR A FIXED PERIOD ONLY

We have the pleasure in offering you a position at______________________ as a __________________________ with effect from________________ 20___. You will be reporting to __________________________________________.

This offer of employment is under the condition only that you will be serving for a fixed term, until __________ 20 ___, where after your employment is considered to be terminated by mutual consent. You will have no expectation, nor does the employer create any expectation that your contract would be extended past the above-mentioned fixed period.

The reason for this employment, as specifically explained to you before, is due to the employer's sub-contract that is for a fixed period only. Your services will be obtained for the duration of this contract only.

The first _______ months of your employment will constitute of a probationary period, on or before which expiry date your position will be reviewed based on work performance, prevailing workloads and general attitude towards your colleagues and superiors.

You are bound by the terms of the Company Codes and Procedures Manual (hereafter referred to as "the Manual"), which serves as the official policy document setting down fixed standards, and should be read in conjunction with the Basic Conditions of Employment Act (BCEA) and/or Bargaining Council for the Industry's Main Agreement as promulgated in the Government Gazette, no. _______ on __________, as amended. All the rules pertaining to this employment relationship are contained therein and will at all relevant time apply to your position.

Your duties, as stipulated in your job description, will be fully discussed by your supervisor during your probation period. This opportunity should be fully utilised in order to equip yourself in meeting our expectations and targets. You are required to take initiative in putting forward relevant questions pertaining to your duties during this time.

Your remuneration will consist of a gross salary of R _______, ___ (____________________________ rands ) per month/week/annum. All deductions such as income tax, whether SITE, PAYE Skills Development Levy or otherwise, will be made by the Company according to the tables produced by the Receiver of Revenue, Unemployment Insurance Fund and/or Workmen's Compensation Commissioner. This will be reflected on your pay slip. Your remuneration will be paid into your personal bank account, which particulars should be verified with our Accounting department.

Your normal working hours shall be from ____ to____. Mondays to _________, but you would be expected to perform additional duties after hours when the need arises. You may be asked to work overtime after normal working hours, as and when required by the employer, subject to the provisions contained in the Manual.

Should you be required to engage in shift work, the provisions contained in the Manual will apply.

You shall be entitled to one day paid annual holiday leave for every seventeen days worked, according to the provisions contained in the Manual.

Any absence due to ill health might result in the approval of paid sick leave according to the provisions contained in the Manual.

You shall be bound by the Disciplinary Code and Procedure and Grievance Procedure as adopted by the Company, more fully described in the Manual.

You are required to fully acquaint yourself with the contents of the Manual and the relevant BCEA or applicable Bargaining Council's Main Agreement, which is available for inspection during office hours.

The parties may terminate this contract by giving at least ____ ( __________ ) week’s written notice. This shall not affect the right of the other party to terminate this contract without notice for any cause recognised in law as sufficient. No holiday leave may be taken during the notice period.

You will be bound by the prevailing arrangements relating to medical aid and pension schemes, where applicable.

I hereby accept and understand the conditions of employment as set out in this offer of employment. I confirm and accept that the contents of this letter have been explained to me, that the contents are fair and reasonable and agree to abide by the terms of this offer.

I accept and understand that I am subject to the conditions laid down in the Company Standards, Policies and Disciplinary Codes and Procedures and their changes from time to time.
